Advertising exemption

THERAPEUTIC GOODS ACT 1989

I, CRAIG DAVIES, Head - Advertising and Export Section, Non-Prescription Medicines Branch, Therapeutic Goods Administration and delegate of the Secretary to the Department of Health and Ageing for the purposes of Section 42DF(1) of the Therapeutic Goods Act 1989, give notice that the restricted representations described in paragraph (a) below, have been approved for use in advertisements directed to consumers, for the products listed in paragraph (b), provided the conditions identified in paragraph (c) are met:

  1. A representation to the effect that advertisements to consumers for the goods described in paragraph (b) may refer to:

    "most asthmatics can take Nurofen, but if you are sensitive to ibuprofen, aspirin or other medicines for pain relief, do not take this product";

  2. Nurofen (ibuprofen 200mg tablet blister pack - reformulation) (AUST R 95381);
    Nurofen (ibuprofen 200mg capsule shaped tablet blister pack - reformulation) (AUST R 95382);
    Nurofen Liquid Capsules (ibuprofen 200mg blister pack) (AUST R 96115); and
    Nurofen Migraine Pain (ibuprofen lysine 342mg tablet blister pack) (AUST R 96215)

  3. the following statement is to prominently appear in all advertisements for the products listed in paragraph (b) where the representation described in paragraph (a) is used -

    "if you have asthma, don't use this product unless a doctor has told you to".
